Caught on Tape: Trooper Stops Motorcyclist on Maryland Highway

HARFORD COUNTY, Md. - A motorcyclist caught a scary moment on tape on a Maryland highway when a man stepped out of a car with a gun in his hand. But it was the motorcyclist who ended up in handcuffs.

From his helmet camera you can see Anthony Graber was speeding on his motorcycle on I-95. He even pops a wheelie. He admits he was showboating, but when he pulled up to a light off an exit in Harford County, a man got out of a car with a gun in his hand.

You can hear the man say, "Get off the motorcycle. Get off the motorcycle...get off the motorcycle, state police."

Graber said about that moment, "I was afraid someone was about to shoot me or steal my motorcycle from me."

If you look at the video, the trooper steps out of an unmarked car, you can't see his badge and it is give seconds before he identifies himself as state police. But it's not the trooper who is in trouble; it's Graber.

"He had been recording this trooper audibly without his consent," stated said one official.

That kind of recording is against the law in Maryland. as a matter of fact, audibly recording somebody without their consent is a felony.

"Police show up at my house today. They come in and they take four computers, two laptops and my camera and they were going to arrest me," shared Graber.

Graber quickly learned the speeding ticket he got that day wasn't the end. He argues the plain-clothed trooper had to know he was being taped because of the visible camera mounted on Graber's helmet. Authorities argue the trooper did nothing wrong.

"He held that gun at this side. When he saw the situation was under he quickly put it away. He never pointed it at anyone," explained said one official.

As far as the illegal recording charge there is a key question that is sure to play out in court. Did the trooper have a reasonable expectation of privacy? He was on a public road with his gun drawn. One could argue that wasn't exactly a private setting.

well you gotto love how they stick together no matter what. oh yeah did you know that you are guilty until proven innocent.

ok the funny thing is that last wednesday their were a bunch of harleys guys(15) or so rode by the gym i go to and they were hauling some ass and it was 10pm. well....the cop that was posted there just watch them go by. now i said to my workout parner "i bet if that was street bike crew the cop would of been on their asses for sure".

unmarked car, no lights, plain clothes... pull gun on someone and tell them what to do.

sounds like a great recipe to me :ugh:

and about the legal case, i dont see how the state can argue that the police should have a reasonable expectation for privacy, pulling a gun on someone in public :rofl:

thats how they roll here bro! they don't really care for you to know what car they drive now. they don't even use the GOV plates anymore.

as far as I know its my right to do those kind of things... and how is it a cop ca nrecord me with out my consent but ican't do the same which in no way shows bodily harm..the system is wrong and we all should be law abiding citizens(pun intended)....
